The DPDP Rules, 2025 contain a framework for transfer of personal data outside India subject to requirements that may be specified by the Central Government.

We retain personal data only for as long as reasonably necessary for the purpose for which it was collected, for legitimate business requirements, or where retention is required by law, contract or other applicable obligations.

Different categories of information may therefore be retained for different periods.

For example, enquiry information may be retained while the enquiry or related business relationship remains active, while employment application information may be retained for recruitment and related administrative purposes.

When information is no longer required, we will take reasonable steps to delete, anonymise or securely dispose of it, subject to applicable legal and regulatory requirements.

The DPDP Rules prescribe specific retention obligations in certain circumstances, including minimum periods for specified processing logs, and therefore A&T’s internal retention schedule should be aligned with the final categories of data and processing actually undertaken.

 

  1. Data Security

A&T Engineering takes reasonable measures designed to protect personal data against unauthorised access, disclosure, alteration, misuse, loss or destruction.

Depending on the nature of the information and the systems involved, security measures may include:

  • Access controls;
  • Password and authentication controls;
  • Secure transmission technologies;
  • System and application security;
  • Backups;
  • Monitoring and logging;
  • Restricted access on a need-to-use basis;
  • Confidentiality obligations; and
  • Other technical and organisational safeguards.

The notified DPDP Rules specifically contemplate safeguards including encryption/obfuscation/masking or virtual tokens, access controls, logging and monitoring, backups, contractual safeguards for processors and technical and organisational measures.

We do not claim that transmission or storage over the internet can ever be completely risk-free.

 

  1. Personal Data Breaches

If A&T Engineering becomes aware of a personal data breach, we will take appropriate steps to assess and contain the incident, mitigate potential harm, investigate the circumstances and make notifications where required by applicable law.

The DPDP Rules require notification to affected Data Principals without delay and provide for specified information to be provided to the Data Protection Board within 72 hours, subject to the framework in the Rules.

Subject to applicable law and the applicable commencement of the relevant provisions, individuals may have rights including:

  • The right to obtain information about personal data being processed;
  • The right to correction of inaccurate or incomplete personal data;
  • The right to request erasure of personal data where applicable;
  • The right to grievance redressal; and
  • The right to nominate another individual in accordance with applicable law.

The DPDP Act expressly provides for access, correction and erasure, grievance redressal and nomination rights.
